1- GENERAL DESCRIPTION
1.1-Register for PLAYGATE
To be able to access most of PLAYGATE's functionalities, we ask you, after accessing the www.playgateapp.com site or the PLAYGATE application and to all PLAYGATE services, whatever their nature (site, applications, services, etc.) , to enter:
– a nickname that you choose freely, within the limits indicated during the entry,
– an optional email address
It is also necessary to accept the Terms and conditions defined in this document.
1.2-PLAYGATE user license
As soon as your account is created in the application, you will benefit from a non-exclusive, non-assignable and non-transferable license for the private use rights of PLAYGATE and its free features for the duration and under the conditions stipulated below.
2- LEGAL PROVISIONS
2.1-Intellectual and industrial property rights
Sarl GLOBA is the sole and exclusive owner of the intellectual property rights concerning all or part of www.playgateapp.com or the PlayGate application and all PLAYGATE services, whatever their nature (site, applications, services, etc.), and in particular on all or part of the elements composing it that are its drawings, its graphic forms, its scenario, its tools, its software, its texts, its sounds, its music, its domain names and its interactivity, whether they are formalized on the site Internet, on CD-ROM, DVD or any other medium.
Access to the site and to the PLAYGATE universe does not confer on the parents of the child and the child any intellectual and industrial property rights relating to all or part of the aforementioned elements and their whole.
Unless expressly authorized in writing by us, the parents of the child and the child may not under any circumstances reproduce, represent, modify, transmit, publish, adapt on any medium whatsoever and by any means whatsoever, or exploit in any way whatsoever, all or part of the PLAYGATE sites.
You are prohibited from scanning, decompiling, disassembling the executable modules integrated into the product, and in general any reverse engineering of our products and software.
You also agree not to scan and attempt to modify the data contained in the files.
Any infringement of the rights of Sarl Globa and PlayGate may be the subject of appropriate legal proceedings and in particular proceedings for infringement.
2.2-Exclusion of users
Sarl Globa reserves, by express agreement, the possibility of deactivating, without notice, any user who by his behavior or his contents would undermine public order or morality and particularly if he issued any content of a pedophile nature, pornographic or discriminatory.
2.3-Site maintenance
We draw your attention to the fact that the site and the PLAYGATE application must, for its optimization and its proper functioning, be regularly updated.
To do this, we may have to perform brief and momentary interruptions of the PLAYGATE services.
2.4-Liability
It is expressly agreed that we cannot be held responsible for any malfunctions of the Internet network affecting the conduct of calls and games on PLAYGATE, the transmission or reception of response times or the loading of games.
Despite our best efforts, we unfortunately cannot guarantee that the site, the application or part of them will operate without interruption, that they will not contain computer errors, that the errors observed will be corrected, or that the site , the application or the servers giving access to it do not contain viruses or other components that may cause damage to users' computer equipment.
Likewise, it is expressly agreed that we cannot be held responsible for any aggressive, inappropriate or illegal behavior on the part of PLAYGATE users, whether such behavior takes place on the PLAYGATE site or not.
Under no circumstances can we be held responsible for the loss or deterioration of user data or for any direct or indirect damage of any kind (material, financial or other) occurring during the course of the use of PLAYGATE.
